General Terms and Conditions (GTC)

for the Online Store of Indian Cobbler Switzerland

1. Scope of Application

These General Terms and Conditions ("GTC") apply to all orders placed through the online store operated by Indian Cobbler Singh (CHE-308.481.656.), trading under the brand name Indian Cobbler Switzerland.

These GTC apply exclusively to consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

3. Conclusion of Contract

The presentation of products in our online store constitutes a non-binding invitation to place an order and does not represent a legally binding offer.

By clicking the "Buy Now" or "Complete Order" button during checkout, you submit a binding offer to purchase the products contained in your shopping cart.

The purchase contract is concluded when we accept your order by sending an order confirmation via email or by dispatching the ordered goods, whichever occurs first.

Your order details and these General Terms and Conditions will be sent to you by email. We do not permanently store the contract text in a form accessible to customers.

4. Prices and Shipping Costs

All prices displayed in our online store are shown in the applicable currency and include any statutory value-added tax (VAT), where legally required.

Any applicable shipping costs will be clearly displayed before you complete your purchase.

5. Delivery

Orders are delivered to the shipping address provided during checkout.

Estimated delivery times are displayed on the respective product page or during the checkout process.

Should exceptional circumstances result in delays beyond the estimated delivery period, we will inform you as soon as reasonably possible.

6. Payment

Payment may be made using the payment methods available during checkout, including, where offered:

The purchase price becomes due immediately upon completion of the order.

7. Right of Withdrawal (Consumers within the European Union)

Right of Withdrawal

If you are a consumer residing within the European Union, you have the statutory right to withdraw from this contract within 14 days, without giving any reason.

The withdrawal period expires 14 days after the day on which you, or a third party nominated by you (other than the carrier), takes possession of the goods.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the standard delivery costs, without undue delay and no later than 14 days after receiving your notice of withdrawal.

Refunds will be issued using the same payment method used for the original purchase unless otherwise agreed.

You are responsible for the direct cost of returning the goods.

Exclusion of the Right of Withdrawal

The statutory right of withdrawal does not apply to goods that:

have been manufactured according to the customer's specifications;
have been personalised;
have been custom-made specifically for the customer.

8. Returns

Our voluntary 30-day Returns & Exchanges Policy applies to eligible purchases and is available on our website.

This voluntary return policy is provided in addition to your statutory rights and does not limit your legal consumer rights.

9. Statutory Warranty

Your statutory warranty rights remain unaffected.

For consumers residing within the European Union, the statutory warranty period is generally two years from delivery of the goods.

For consumers residing in Switzerland, the applicable provisions of the Swiss Code of Obligations shall apply.

10. Voluntary Manufacturer's Warranty

In addition to your statutory rights, Indian Cobbler Singh (CHE-308.481.656.) provides a voluntary Two-Year Manufacturer's Warranty covering manufacturing defects under normal conditions of use.

This voluntary warranty does not affect your statutory warranty rights.

11. Liability

We shall be fully liable for damages resulting from:

death;
personal injury;
damage to health;
intentional misconduct; or
gross negligence.

In cases of slight negligence, our liability shall be limited to breaches of essential contractual obligations and restricted to the foreseeable damage typically associated with such contracts.

Any further liability is excluded to the extent permitted by applicable law.

12. Retention of Title

All goods remain the property of Indian Cobbler Singh (CHE-308.481.656.) until full payment has been received.

13. Data Protection

The collection and processing of personal data are carried out in accordance with our Privacy Policy.

14. Governing Law

These General Terms and Conditions shall be governed exclusively by the laws of Switzerland, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

If you are a consumer residing within the European Union, any mandatory consumer protection provisions applicable in your country of residence shall remain unaffected.

15. Severability

Should any provision of these General Terms and Conditions be held to be invalid or unenforceable, the remaining provisions shall remain unaffected and continue in full force and effect.
