General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions apply to all orders placed by consumers through the online shop of Indian Cobbler Switzerland.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed in nature.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

By clicking the “Buy Now” button, you submit a binding offer to purchase the goods in your shopping cart. The contract is concluded once we confirm your order by email or dispatch the goods.

The contract text is not stored permanently by us. Order details are sent to you by email.

4. Prices and Shipping Costs

All prices shown include the applicable statutory value-added tax, where required by law.

Additional shipping costs may apply. Any applicable shipping costs are clearly indicated during the ordering process.

5. Delivery

Delivery is made to the address provided by the customer during the order process.

Delivery times are indicated in the online shop. If no delivery time is specified, delivery generally takes place within the stated production or shipping timeframe.

6. Payment

Payment is made using the payment methods offered during the checkout process, such as credit card, PayPal, TWINT, or Apple Pay.

The purchase price is due immediately upon conclusion of the contract.

7. Right of Withdrawal (EU Consumers)

Right of Withdrawal

Consumers residing in the European Union have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you or a third party designated by you has received the goods.

To exercise your right of withdrawal, you must inform us of your decision by a clear statement (e.g. by email).

Consequences of Withdrawal

If you withdraw from the contract, we will reimburse all payments received from you, including standard delivery costs, without undue delay and no later than 14 days from the day we receive notice of your withdrawal.

Refunds will be made using the same means of payment used for the original transaction.

You shall bear the direct cost of returning the goods.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to goods that

  • are clearly personalized (e.g. custom-made or personalized products).

For consumers in the European Union, the statutory warranty period is two years from receipt of the goods.
For consumers in Switzerland, the provisions of the Swiss Code of Obligations apply.

11. Liability

We shall be liable without limitation for damages resulting from injury to life, body, or health, as well as for damages caused by intent or gross negligence.

In cases of slight negligence, we shall only be liable for breaches of essential contractual obligations and limited to foreseeable, typical damages.

Any further liability is excluded to the extent permitted by law.

12. Retention of Title

The goods remain our property until full payment has been received.

13. Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy.

14. Governing Law

Swiss law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

For consumers residing in the European Union, mandatory consumer protection provisions of the country of residence remain unaffected.

15. Severability Clause

Should any provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.
